DWI/DUI Legal Process In Missouri
Getting a DWI/DUI in Town and Country or anywhere in the St. Louis area can be a life-changing event. In recent years the state of Missouri has strengthened DWI/DUI laws, and the municipalities like Town and Country, MO have increased their DWI enforcement. Every year there are over 7000 DWI’s in and around the St. Louis area, and Town and Country have one of the highest DWI enforcement rates in Missouri. Now Combs Law Group doesn’t condone drinking and driving under any circumstances, however, we believe everyone is entitled to due process. We also know from experience that if someone doesn’t hire good legal representation the punishments for a DWI can be life-changing for years to come. Let’s take a look at some of the DWI laws in the state of Missouri, and break down how it’s going to impact your life.
Missouri DWI laws include specific guidelines for blood alcohol levels (BAC) while you’re driving a motor vehicle. If a driver is proven to have a BAC of .08 or higher they are considered legally impaired to drive under the law. If you were proven to have a BAC of .15 or higher that could be considered an aggravated DWI, which could mean stricter penalties. Every driver in Missouri is subject to something called “implied consent”. This basically means that by driving under a Missouri drivers license you agree to submit to alcohol and drug testing when requested by the law enforcement officer. If you refuse the test at the time of your arrest you could be looking at an immediate revocation of your license for 1 year. For those that fail the test and get charged with a DWI, the following penalties are a possibility for your criminal case:
- First DWI offense is typically filed as a class B misdemeanor
- Max jail time for a first offense DWI is 6 months
- Max fine for a first offense DWI is $500
- Up to one year in jail for second offense DWI
- Max fines of up to $1,000 for a second offense DWI
- One year or five years license suspension if the second DWI offense was within five years of the last offense
- You’ll have to install an ignition interlock device in your car for a minimum of 3 months for a first offense DWI
- Max 4 years in jail for a third or multiple offense DWI
- Max fine of $5000 for a third or multiple offense DWI
- Up to 10 years license suspension for 3rd or multiple offense DWI
- You may have to complete a SATOP course which can cost up to $500
- You may have to complete a “Victims Impact Panel” course
